Terms of Service

These Terms of Service govern your use of Updateberry, including our repository-connected workflows, AI-assisted content generation, hosted changelogs, widgets, announcements, waitlist, and free tools.

1. Who Can Use Updateberry

You must be at least 18 years old and able to enter into a binding contract to use Updateberry. If you use Updateberry on behalf of a company or other organization, you represent that you have the authority to bind that organization to these Terms.

2. Your Account and Repository Access

You are responsible for your account, your login credentials, and all activity that occurs under your account. You may connect only repositories that you own or are authorized to access. This includes private repositories if you choose to grant Updateberry access to them.

Updateberry stores repository access tokens in encrypted form so the service can sync repository data, generate content, and support connected workflows. You are responsible for disconnecting repositories you no longer want Updateberry to access.

3. What the Service Does

Updateberry helps you turn repository activity into customer-facing content. The service may:

  • import repository and commit metadata from connected providers such as GitHub
  • classify commits and summarize product changes using AI services
  • generate draft assets such as release notes, changelog entries, social posts, email copy, and ad copy
  • let you publish hosted changelogs and distribute those updates through RSS, widgets, announcements, and email digests

4. AI-Generated Output Requires Review

Updateberry uses AI to help classify commits and generate draft content. AI output is provided as a drafting and workflow tool only. It may be incomplete, inaccurate, misleading, offensive, or unsuitable for your intended use.

You are solely responsible for reviewing, editing, approving, and deciding whether to publish, send, embed, or otherwise rely on any output generated through the service. Updateberry does not guarantee that AI output is accurate, non-infringing, compliant, or fit for any legal, regulatory, marketing, or commercial purpose.

5. Your Content and Your Rights

You retain your rights in the content, repository data, brand instructions, subscriber lists, and other material you submit to Updateberry. You grant Updateberry a limited right to host, process, transform, reproduce, and transmit that material as needed to operate, secure, and improve the service for you.

You represent that you have all rights, permissions, and legal bases needed to submit that material to the service, to have it processed by our service providers, and to publish or distribute resulting content.

6. Public Publishing and Distribution

Updateberry can make your content public through hosted changelogs, custom domains, RSS feeds, widget feeds, embeddable scripts, in-app announcement endpoints, and email digests. Once you publish or send content through these surfaces, it may be copied, cached, forwarded, indexed, archived, or retained by third parties even if you later edit or unpublish it.

You are solely responsible for the public content you publish or distribute through Updateberry, including making sure it does not contain confidential information, personal data you are not allowed to disclose, export-controlled material, unlawful content, or content that infringes another party's rights.

7. Custom Domains, Widgets, and Embeds

If you use a custom domain, you represent that you control that domain and have the right to configure the required DNS records. Updateberry may refuse, suspend, remove, or revoke custom-domain support if verification fails, the domain creates legal or abuse risk, or continued support would harm the service or other users.

If you install Updateberry widgets or announcement scripts on a website or application, you are responsible for making sure you are authorized to do so and for providing any notices, disclosures, or consents required under applicable law.

8. Subscriber Lists, Waitlist, and Email Use

If you upload, manage, or send to subscriber lists through Updateberry, you are responsible for obtaining the necessary consent and for complying with anti-spam, privacy, and marketing laws. Updateberry does not verify whether your recipients consented to receive your communications.

If you join our waitlist or unlock results from our free tools, you agree that Updateberry may send follow-up emails, product updates, and related marketing communications until you unsubscribe. We may also store attribution data such as landing-page variant, referrer, and UTM parameters.

9. Paid Plans and Future Billing

Updateberry may offer paid plans, usage limits, premium features, or subscription billing. As of the date above, paid checkout may not yet be active in all environments. If and when paid subscriptions become available, we may publish additional pricing, billing, renewal, cancellation, refund, and plan-specific terms.

We may change plan structure, pricing, limits, promotional offers, beta programs, or feature availability at any time, subject to applicable law.

10. Acceptable Use

You may not use Updateberry to:

  • access repositories, websites, domains, subscriber lists, or systems without authorization
  • submit unlawful, infringing, defamatory, deceptive, harassing, or abusive material
  • send spam or upload recipient lists without the necessary rights or consent
  • scrape, overload, probe, or interfere with the service or related infrastructure
  • reverse engineer the service, bypass limits, misuse tokens, or attempt unauthorized access
  • use the service in a way that creates security, legal, or reputation risk for Updateberry or others

11. Suspension, Removal, and Termination

We may suspend or terminate access to the service, remove hosted content, disable public endpoints, or revoke custom-domain or embed functionality if we believe there is a violation of these Terms, abuse of the service, unlawful activity, excessive risk, or a need to protect Updateberry, our users, or third parties.

We may also remove content or limit functionality when reasonably necessary for legal, operational, security, reputation, or platform-integrity reasons.

12. Data Deletion Requests

You may request deletion of your account and associated data by contacting us. We will process deletion requests within a reasonable time, subject to any legal, security, fraud-prevention, backup, or operational retention needs.

Public copies of previously published or distributed content may continue to exist outside Updateberry's control, including in caches, archives, feeds, forwarded emails, or third-party systems.

13. Disclaimers

Updateberry is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

14. Limitation of Liability

To the maximum extent permitted by law, Updateberry and its affiliates, founders, employees, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, business opportunity, or public-relations harm arising from or related to your use of the service.

To the maximum extent permitted by law, our total liability for all claims arising out of or relating to the service will not exceed the greater of $100 USD or the amount you paid us for the service in the 12 months before the event giving rise to the claim.

15. Changes to These Terms

We may update these Terms from time to time. If we make a material change, we may provide notice through the service, by email, or by updating the effective date at the top of this page. Your continued use of Updateberry after the updated Terms take effect means you accept the revised Terms.
